Man Suffers A Mild Traumatic Brain Injury When Scaffolding Falls On His Head In A Defective Product Case
A 45-year-old man sustained a mild traumatic brain injury (MTBI) while he and two other men were loading scaffolding on a cart with rollers. The improperly tied down scaffolding came loose and fell on his head. The defense claimed that the man did not actually suffer any brain damage, and relied on the fact that the man did not “look injured.”
Winer, Burritt & Scott, LLP, retained a biomechanical engineer, a physiatrist, a neuropsychologist and a vocational specialist to prove the presence of an MTBI, the extent of the damage and the impact the damage would have on the man’s life in the future.
The firm also retained a mechanical engineer to show that the cart was a defective product that was improperly manufactured, thus making the manufacturer liable. The engineer highlighted the fact that the cart did not have any locks on the wheels and it did not have a sufficient system in place to secure the scaffolding.
Result: $950,000 settlement in favor of the injured man.
