Plaintiff, a salesman for a Southern California software company was sexually harassed by a male officer of the company. Once he reported the sexual harassment the company chose to protect the perpetrator and take away a number of important responsibilities of the plaintiff. Winer, Burritt & Scott, LLP were retained and made the claim that the sexual harassment against the perpetrator was actionable and that the company retaliated against plaintiff once he did complain by engaging in adverse employment actions. Further, Winer, Burritt & Scott, LLP had plaintiff evaluated by a psychological expert who found that he had been seriously injured as a result of the conduct of the company and required extensive future psychological treatment. Plaintiff continued to work for company up until the time of settlement.
RESULT: Settlement in favor of plaintiff $850,000.
