The Plaintiff was a woman in her 20’s who was an unbelted passenger in an automobile. The driver of the vehicle fell asleep, causing the vehicle to travel off the highway and eject Plaintiff from the vehicle, causing her to be rendered a paraplegic. Plaintiff contended the highway should have had guardrails as the highway embankment was steep.
