The defendant claimed that the misconduct of its supervisor did not meet the severe and pervasive standards of sexual harassment.
The law offices of Winer, Burritt & Scott, LLP, was able to develop evidence which tended to establish that the supervisor had engaged in similar conduct in the past with at least two other employees and that the bank was aware of his misconduct but did not fire the supervisor because he was a major money producer for the bank; that the sexual harassment, although not as severe as in some cases, did effect the plaintiff’s ability to perform her job duties and caused her emotional distress, although she never sought the services of a psychotherapist.
RESULT: Settlement on behalf of plaintiff for $350,000
