Plaintiff was a passenger in a pickup truck returning Lake Tahoe. The driver lost control of the truck and plaintiff, a young woman, developed mild scars on her face. The case involved an uninsured motorist claim since the defendant was not insured.
The defense admitted liability for the accident but claimed that plaintiff’s facial scars had largely healed; thus, the case was not worth very much money. The law offices of Winer, Burritt & Scott, LLP, retained a psychiatrist and a psychologist who performed psychological testing to indicate that the scars did have a significant psychological impact on her and the case settled for the policy limits. Before the law offices of Winer, Burritt & Scott, LLP, came into the case, the defense had only offered $20,000.
RESULT: Settlement on behalf of plaintiff for $300,000
