Plaintiff in this case was a 35-year-old woman who was seeing an anesthesiologist who was a chronic pain specialist. Plaintiff had chronic pain after multiple failed back surgeries. The anesthesiologist had the plaintiff on a number of different drug “cocktails” which significantly affected her inhibitions. Plaintiff alleged that the physician inappropriately entered into a sexual relationship with her. The physician denied the sexual relationship and stated that all medical treatment was reasonable. The law offices of Winer, Burritt & Scott, LLP, was able to find proof which tended to indicate that the sexual relationship existed and that, due to the defendant’s position of power as her doctor and over-medication, plaintiff could not consent to the relationship.
RESULT: Settlement on behalf of plaintiff of $250,000
