In this case, four boys alleged that they were sexually molested by a priest of their church.
The church took the position that it did not have any liability because the priest was not within the course and scope of his employment when alleged molestations occurred and that the church had no notice of any problems with the priest.
The law offices of Winer, Burritt & Scott, LLP, was able to turn up a witness who testified that he had reported that he was sexually molested by the same priest to high-ranking church officials and they ignored his complaint and warning that other children would be molested if the church did not do something. The high-ranking church officials all denied under oath that this report occurred.
