Plaintiffs were the survivors of a 70-year-old man, who was crushed to death against a building when defendant thought that she was in reverse while pulling out of a diagonal parking space when in fact she was in drive.
The defense claimed that the survivors, children of the decedent, did not suffer very much loss of society and comfort because they rarely saw their father. The law offices of Winer, Burritt & Scott, LLP, was able to establish that there was a close bond in the family even though they lived some distance apart and settled for more than the policy limit.
